Welcome to Akira Fresh ("Company", "we", "our", or "us"). These Terms & Conditions ("Terms") govern your access to and use of the Akira Fresh website, mobile application, and any related services (collectively referred to as the "Platform"). By accessing, browsing, registering, or placing an order through our Platform, you agree to be bound by these Terms. If you do not agree with these Terms, please refrain from using our Platform.

1. Eligibility

You must be at least 18 years of age and legally capable of entering into binding contracts under applicable laws of India to use our Platform and place orders. By using our Platform, you represent and warrant that you satisfy these eligibility requirements.

2. Products & Availability

Akira Fresh offers fresh meat, frozen foods, ready-to-cook products, marinades, and related food products.

  • All products are subject to availability.
  • Product images are for illustration purposes only.
  • Packaging may vary from the images displayed.
  • We reserve the right to discontinue or modify any product without prior notice.

3. Pricing

All prices displayed on the Platform are in Indian Rupees (INR) and are inclusive of applicable taxes unless otherwise stated.

Akira Fresh reserves the right to:

  • Change product prices without prior notice.
  • Correct pricing errors.
  • Withdraw promotional offers at any time.
  • Cancel orders affected by pricing inaccuracies.

4. Order Acceptance

Placing an order does not guarantee acceptance.

Akira Fresh reserves the right to:

  • Reject or cancel any order.
  • Limit purchase quantities.
  • Cancel duplicate or suspicious orders.
  • Refuse orders due to stock unavailability or operational reasons.

If your order is cancelled after payment, the applicable refund will be processed in accordance with our Refund Policy.

5. Delivery

Orders are delivered only to serviceable locations. Estimated delivery timelines are indicative and may vary due to:

  • Product availability
  • Weather conditions
  • Traffic
  • Public holidays
  • Operational constraints
  • Force majeure events

Akira Fresh shall not be liable for delays caused by circumstances beyond its reasonable control.

6. Cold Chain & Product Handling

Our frozen and chilled products are transported through a temperature-controlled cold chain to maintain freshness and food safety. Customers are advised to:

  • Inspect products upon delivery.
  • Refrigerate or freeze products immediately.
  • Follow storage and cooking instructions printed on the packaging.

7. Customer Responsibilities

Customers agree to:

  • Provide accurate personal and delivery information.
  • Ensure someone is available to receive the order.
  • Verify products at the time of delivery.
  • Maintain confidentiality of their account credentials.

Any misuse of the Platform may result in suspension or termination of the account.

8. Payments

We accept payments through secure third-party payment gateways. Available payment methods may include:

  • UPI
  • Credit Cards
  • Debit Cards
  • Net Banking
  • Wallets
  • Cash on Delivery (where available)

Akira Fresh does not store complete payment card information.

9. Cancellation & Refunds

Cancellation and refund requests shall be governed by our Cancellation & Refund Policy. Due to the perishable nature of our products, returns may not be accepted except in cases of:

  • Damaged products
  • Incorrect products delivered
  • Missing items
  • Quality concerns reported within the prescribed time

10. Promotions & Offers

Promotional offers are:

  • Valid for a limited period.
  • Subject to individual campaign terms.
  • Non-transferable.
  • Not redeemable for cash unless specifically stated.

Akira Fresh reserves the right to modify or withdraw offers without prior notice.

11. Intellectual Property

All content available on the Platform, including but not limited to:

  • Logos
  • Trademarks
  • Product names
  • Images
  • Graphics
  • Videos
  • Website design
  • Text

is the exclusive property of Akira Fresh or its licensors and is protected under applicable intellectual property laws. No content may be copied, reproduced, distributed, or used without prior written permission.

12. User Conduct

You agree not to:

  • Use the Platform for unlawful activities.
  • Upload malicious software or harmful content.
  • Attempt unauthorized access to our systems.
  • Interfere with Platform operations.
  • Misrepresent your identity.

Violation of these Terms may result in suspension or permanent termination of your account.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Akira Fresh shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

  • Use or inability to use the Platform.
  • Delay in deliveries.
  • Product availability.
  • Third-party payment failures.
  • Technical interruptions.

Our maximum liability shall not exceed the value of the order giving rise to the claim.

14. Privacy

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

15. Force Majeure

Akira Fresh shall not be responsible for any delay or failure in performance arising from events beyond our reasonable control, including but not limited to:

  • Natural disasters
  • Floods
  • Fires
  • Pandemics
  • Government restrictions
  • Labour disputes
  • Power failures
  • Internet outages

16. Changes to Terms

Akira Fresh reserves the right to amend these Terms & Conditions at any time.

Revised Terms shall become effective immediately upon publication on the Platform. Continued use of the Platform constitutes acceptance of the updated Terms.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts in New Delhi, India.
